4. Fees for using APIMATIC.IO
APIMATIC provides a paid service. Depending on your plan and usage, you must must provide us with a valid credit card number. The fees charged for having an account are as set out at https://apimatic.io/pricing (“Fees”). In the event that you exceed your allowance of KLOCs (refer to FAQ at https://apimatic.io/pricing), you will be charged per KLOC as at the rate defined by your chosen plan. Subscription fees are charged in advance and are non-refundable.
However if you are a New Zealand subscriber, notwithstanding anything in this Agreement, you may have the benefit of certain rights or remedies pursuant to the New Zealand Consumer Guarantees Act 1993. Under this Act are guarantees which include that software is of acceptable quality. If this guarantee is not met there are entitlements to have the software remedied (which may include repair, replacement or refund). If a remedy cannot be provided or the failure is of substantial character the Act provides for a refund.
5. Limitations
In no event shall APIMATIC.IO or its suppliers or partners will be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on APIMATIC.IO’s Internet site, even if APIMATIC.IO or a APIMATIC.IO authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
